Documents Needed for Divorce and Family Law

As a client, your attorney will ask you to provide to us for the purpose of sharing the information with the court and with the opposing party, any of the following personal and financial documentation:

Paystubs

The most recent three months of paycheck stubs from your employer showing itemized gross, deductions, and net income along with year to date figures. Divorce and Family Law cases and child support cases will need paystubs for your Attorney and the opposing party and the court.

State and Federal Income Tax Returns

In Divorce and Family Law Custody and Support cases, you will need to provide the most recent three years of state and federal income tax returns, with all attachments including W2 statements, 1099s and unemployment benefits.

Health Insurance Coverage Cost

A statement from your health insurance showing persons covered and cost of coverage for just yourself and cost of coverage for family. Divorce and Family Law custody cases along with child support make health insurance relevant.

Pensions, 401(k), IRA, Retirement accounts

All defined benefit and defined contribution pension accounts through your employer and all personal IRAs most recent statements showing present value. Divorce and Family Law Attorney will need for division by QDRO.

Stock Market / Managed agency accounts

Most recent statement of any stock accounts you have showing value. Divorce divides all financial assets including stock so you will need to provide to your Attorney.

BANK ACCOUNTS

Most recent bank statements showing value and transactions for checking, savings, certificates of deposit joint and individual accounts Divorce and Family Law cases require full financial disclosure.

REAL ESTATE DOCUMENTS

For all real estate either or both parties have an interest in, provide a copy of most recent property tax statement, a copy of the recorded deed giving you an interest with the legal description on it and any appraisals for value and the most recent mortgage statements showing balance owed on mortgage.

Motor & Recreational Vehicles

For each motor vehicle, car, motorcycle, snowmobile, ATV, boat, motor either or both parties have an interest in, provide a internet printout Kelly Blue Book showing your opinion as to present value with year make and model, for each state the balance of any loans outstanding, and indicate which party wants it. Divorce and Family Law cases divide the net equitable value.  Discuss with your Attorney.

UNSECURED DEBTS

A list of all outstanding unsecured credit card or other debts with a balance with most recent statement showing:  1)  Name of Creditor  2) Whether debt is joint or individual 3) Balance total and 4) Minimum monthly payment. Divorce and Family Law Attorney will tell you debts are divided just like property.
